Terms of Service
These are the rules for using VIA. They are short and written in plain English, because rules nobody reads are not rules.
This page is also available in Italian. The two versions say the same thing. If they ever differ, the Italian version prevails, except where a mandatory rule of law that is more favourable to you as a consumer says otherwise.
You need to be 14 or older to create an account.
In Italy that is the whole rule; for other countries we apply a higher age, listed under “The minimum age where you live”. When you sign up you give the month and year you were born and the country you live in, our server works out your age and checks it against that country's minimum, and if you are too young the account is refused there and then — before anything about you is saved. If you sign in with Apple or Google, the account exists a moment before you are asked; if you are too young it is deleted at once.
Neither your month and year of birth nor your country is kept. They are used for that check and then thrown away. The Privacy Policy explains that in full.
Who provides VIA
VIA is provided by Andriy Mrichko (individual developer of VIA), Via dei Ciliegi 11, 00071 Pomezia (RM), Italy. P.IVA 11237521007. VIA is made by one person and not by a company. These terms are an agreement between you and Andriy Mrichko, who is also the data controller — the titolare del trattamento — named in the Privacy Policy. For anything about your personal data, write to privacy@viastudy.app; for help with the app, to support@viastudy.app.
VIA is offered only in the European Union and the European Economic Area. At launch the app is distributed through the App Store of those countries and nowhere else. These terms are written for people who live there.
The minimum age where you live
The age you must have reached depends on the country you live in. These ages are our own choice, made out of caution. For each country we have taken the age at which its data-protection law lets a young person agree by themselves to an online service using their data — its “digital consent age” — and we use it as the minimum for an account, although VIA does not rely on your consent to work (the Privacy Policy says what it relies on instead). Where the age below is higher than a country's law would require, that is deliberate.
| Minimum age | If you live in |
|---|---|
| 14 | Italy. |
| 15 | Czechia, Denmark, France, Greece, Slovenia. |
| 16 | Croatia, Germany, Hungary, Ireland, Liechtenstein, Luxembourg, the Netherlands, Poland, Romania, Slovakia — and every country not named in this table. |
Every country we have not yet checked is 16. That is the highest age the EU's rule lets a country set, so we apply it wherever we have not read the country's own law — including countries whose law allows a younger age. As we check more countries this table will change, and the date at the top of this page with it.
The app asks, and our server applies the age. Sign-up asks for the month and year you were born and the country you live in. The country starts on the one your phone is set to, and you can change it. In the month of your birthday we count you as not yet a year older. Our server then refuses an account below that country's minimum, with a message that does not say which age would have been enough, and the app does not offer sign-up again on that device for 24 hours. What you choose is what we go by: VIA does not check where you actually are or ask for a document, so answer truthfully. If we learn that an account belongs to someone below the minimum age for their country — a parent can tell us at privacy@viastudy.app — we close it and delete what is in it.
If you are under 18
Use VIA with a parent or guardian knowing about it: show them this page and the Privacy Policy. A paid plan is bought with an Apple Account, and Apple's own terms require a minor to buy with a parent's agreement; if your Apple Account is part of Family Sharing, Ask to Buy sends the purchase to the family organiser to approve.
Parents can write to us at privacy@viastudy.app. If a parent or guardian of someone under 18 asks us to, we close that person's account, or move it back to the Free plan, and for a refund of a purchase we point them to Apple, which took the payment.
What VIA is
VIA is a study app. You put your own study material into it — text you paste, a web link, a video, a PDF or an office document — and you can ask questions about that material, with photos attached to a question if you like. An AI model reads what you gave it and writes the answers. You can also record a lesson. Recording on its own sends nothing to the AI model — the audio stays in your storage. If you ask for a recording to be written out, that audio is sent to Google to be turned into text. If you ask from inside a topic, the text is stored there as study material you can ask questions about like any other. If you ask from your Recordings list or the recording's own page, the text is kept with the recording, and you cannot ask questions about it. Where that audio goes, and what Google may do with it, is set out in the Privacy Policy under "Recording a lesson". There is also a focus timer and a timetable, and VIA can write you a set of flashcards or a quiz inside an answer.
When you chat with VIA or talk to it, you are dealing with an AI, not a person. The app says so at the start of every new chat and of every voice conversation. The voice you hear in Speak and in an audio summary is synthetic. An audio summary begins with a spoken sentence saying it was generated by VIA's artificial intelligence, and its file carries a tag saying the same.
What VIA is not
The answers can be wrong. VIA is built on an AI model, and AI models confidently state things that are not true. Treat what VIA tells you the way you would treat an explanation from a classmate who has read the material: useful, worth thinking about, and worth checking before you rely on it.
You confirm this when you sign up. To create an account you tick a box that says: “I understand that VIA is an AI and its answers may contain errors: I'll check important things against my material.” We keep a record of when you ticked it.
In particular:
- Check anything you are going to hand in, be marked on, or repeat in an exam.
- VIA is not your teacher and does not replace one.
- VIA does not give medical, legal or financial advice, and you should not treat anything it says as though it does.
- VIA is not a tool for assessing students. It is a personal study aid, and its quizzes are for checking yourself. It is not made for, and may not be used by, a school or anyone else to mark students, to decide who is admitted or promoted, or to watch over tests and exams.
Your account
- Use an email address you actually control. When you sign up we ask for a link confirming that address to be emailed to it, and you need to open that link before you can sign in — so an address you cannot read is an account you cannot get into. If you sign in with Apple or Google instead, there is no link and no password: your Apple or Google account is what lets you in, so keeping that account safe is keeping your VIA account safe.
- Your account is yours. Do not share your password with anyone, and do not sign in to somebody else's account.
- Tell us at support@viastudy.app if you think somebody else has got into your account.
- You can stop using VIA whenever you like. To have your account and everything in it deleted, use Settings in the app, or write to privacy@viastudy.app and we will do it for you — the Privacy Policy explains exactly what gets removed.
- An account nobody uses is deleted after 24 months. We email the account's address 30 days before, and opening VIA while signed in during those 30 days keeps the account. An account with a paid plan running is not deleted this way.
Subscriptions and payments
VIA is free to use within the limits of the Free plan. Lite and Pro are paid plans with higher limits, each sold by the month or by the year. There is no free trial.
- You buy from Apple. Plans are sold inside the app through Apple's App Store. Apple is the seller: it charges the payment method on your Apple Account and sends you the receipt. We never see your card.
- The price is the one the App Store shows you before you confirm, in the currency of your App Store country. We publish no other price. If the price of a subscription you already have goes up, Apple tells you beforehand and, where its rules require it, asks you to agree; if you do not, the subscription ends when the period you have paid for ends.
- A subscription renews by itself. At the end of each month or year it renews for the same period and is charged to your Apple Account, unless you cancel at least 24 hours before the period ends.
- You cancel in your Apple settings, not in VIA: open Settings on your iPhone or iPad, tap your name, then Subscriptions, then VIA. We cannot cancel for you. Deleting the app, or deleting your VIA account, does not cancel a subscription — cancel it first, or Apple goes on charging you.
- After you cancel, you keep your plan until the end of the period you have paid for. Then your account goes back to Free. Nothing you have put into VIA is deleted or locked when a plan ends: it stays where it is and you can still open it. The Free plan's limits apply to what you do from then on.
- If a payment fails, Apple keeps trying for up to 16 days and you keep your plan while it does. If the payment still has not gone through, the plan ends and your account goes back to Free.
- Withdrawal and refunds go through Apple. Subscriptions are bought from Apple, which is the seller. The right of withdrawal and refunds are governed by Apple's terms and are requested from Apple (reportaproblem.apple.com). The rights the law of your country gives you as a consumer are unaffected. If Apple refunds you, the plan ends at once.
- Changing plan. Moving from Lite to Pro takes effect at once, and Apple refunds the part of Lite you have not used. Moving from Pro to Lite takes effect at your next renewal: you keep Pro until then. For a change between monthly and yearly, and for anything else not covered here, Apple's rules for subscriptions apply.
- One subscription, one VIA account. A subscription belongs to the Apple Account that bought it and gives its plan to one VIA account at a time. If you press Restore purchases in a different VIA account, the plan moves to that account and the other one goes back to Free.
- If you are under 18, see “If you are under 18”: a purchase needs a parent's agreement, and Ask to Buy is how Apple collects it.
The material you put in
Your study material stays yours. Putting it into VIA does not give us ownership of it.
What you do give us is permission to do the things VIA obviously has to do with it in order to work: store it, break it into pieces so it can be searched, and send the relevant parts to Google's AI model so that your question can be answered from your own material. When a topic or a chat has no name yet, we also send the start of what you put into it — a message, or a material — to that same model, so that VIA can give it a name. That stops once it has a name, and a topic you have named yourself is never sent for this. A photo you attach to a message is stored with your chat and sent to that same model with the message, and with later messages in that chat while it is one of the most recent. When you add a web link, we also ask that same website for its icon and keep it, so the topic can show it. That is all we use it for. We do not sell it, and we do not hand it to anyone not named in the Privacy Policy.
Three things to keep in mind when you decide what to put in:
- Only add material you are allowed to add — your own notes, or something you have the right to use.
- If you record a lesson, you record it for your own study and for nothing else. Make sure people around you know you are recording: a microphone picks up whoever is in the room, and the app says so under the record button, every time. Follow your school's rules and what your teacher tells you — many schools allow a phone in class only when the teacher has agreed. Do not share a recording, its transcript or its summary with other people, and do not post them anywhere: passing on other people's voices needs their agreement, and that is yours to get, not ours.
- Do not put in things that are nobody's business but yours. Medical details, somebody else's personal information, passwords. VIA is a study tool and there is no reason for any of that to be in it.
If you are a teacher, or anyone else, and you are in a recording somebody made with VIA, you can write to privacy@viastudy.app and ask us to delete it. The Privacy Policy says how we handle that.
Things you may not do
- Use VIA to break the law, or to harass, threaten or impersonate anybody.
- Upload material you have no right to.
- Use VIA to cheat: to pass off its work as your own in homework, a test or an exam where your school's rules do not allow that, or to get answers during one.
- Upload or keep a recording you made without the people in it knowing they were being recorded.
- Try to break into the service, get at other people's accounts, or get round the limits on your own.
- Automate VIA to hammer it with requests — it is for a person studying, not a script.
- Point VIA at a web address to make our server reach somewhere it should not.
If you do these things we may suspend or close your account. Where it is something we could reasonably talk to you about first, we will.
The service can change
VIA is being built. Features will appear, change and sometimes be removed, and the service can be interrupted — for maintenance, or because one of the companies it runs on has a fault. We work to keep it available and to keep what you store in it, and we will tell you in the app before removing a feature you may be relying on. No online service can rule out a fault, so keep your own copy of work that matters to you.
Your app settings are stored only on your phone: if you delete the app they go with it, and we cannot get them back for you. Your subject list and your timetable are saved to your account as well, so they come back when you sign in again. The Privacy Policy sets out what is kept only on the phone, what we hold a copy of, and what happens to all of it if you delete your account.
What we answer for
VIA is a study aid whose answers are written by an AI model from the material you give it. An answer is the model's best attempt, not a checked fact, and using VIA properly includes checking what matters, as What VIA is not says. That description is part of what you can expect from the service: an answer that turns out to be wrong is something VIA can do, not a fault in it.
Within that, we provide VIA with the care that can reasonably be expected of us and as these terms and the app describe it. Nothing in these terms excludes or limits our liability for harm we cause deliberately or through gross negligence, or takes away a right the law gives you as a consumer — including the legal guarantee that a digital service conforms to what was agreed, which holds even though a paid plan is sold through Apple.
Apple's licence agreement
You get the app from Apple's App Store. The licence to use it is Apple's standard Licensed Application End User License Agreement — the one that applies to every App Store app whose developer has not written a licence of its own. These terms add to that agreement and do not replace it: they say how the VIA service works, what you may do with it and what we owe you. The agreement is between you and us; Apple is not a party to these terms and is not responsible for VIA or for supporting it.
Which law applies, and disputes
Italian law applies to these terms, without taking away the protection of the mandatory rules of the country where you habitually live, if you are a consumer living in another country.
If you are a consumer, any dispute goes before the court of the place where you live or are domiciled, and you may bring a claim there; these terms name no other court. If something goes wrong, write to us first at support@viastudy.app — most things can be settled that way — and you can also turn to an alternative dispute resolution (ADR) body for consumer disputes in your country.
Changes to these terms
If these rules change, this page changes and the date at the top changes with it. If a change is a significant one we will tell you in the app rather than expect you to notice.
